YOUR INFORMATION

How BA40 collects, uses and protects your information, wherever you are in the world.

Effective date: November 2, 2026 · Last updated: November 2, 2026

This Privacy Policy explains how BA40 and BA40 FEMME (together, “BA40”, “we”, “us”) collect, use, share and protect personal information when you visit ba40fit.com, use our free tools, or join our online coaching. BA40 is an online fitness coaching and education business operated from Canada that serves people around the world. By using this site you acknowledge this policy. Where the law requires your consent, we ask for it separately, and you can withdraw it at any time.

1. Who is responsible, and how to reach us

BA40 is the organization responsible for your personal information. Our person responsible for privacy is Coach J. Contact us at coach@ba40fit.com for any privacy question, request or complaint.

2. What we collect

Free 7-Day Reset. First name, email address, optional main goal, and whether you chose to receive marketing emails.

BA40 Scorecard (men’s and FEMME versions). Your answers to the quiz, which produce a score, tier and focus areas. If you choose to send your result to us, we also collect your first name, email address, body weight, main goal and the estimates the tool calculates (such as protein range, step target and a calorie estimate). The FEMME scorecard also collects your age, height and activity level. Your answers are calculated in your browser and are only sent to us when you submit the form with your consent.

Coaching applications. Name, email address, phone number (on some forms), age range, goals, biggest challenge, training experience, preferred start time, the outcome you want, and how comfortable you are with the investment.

If you become a coaching client. Information you choose to share to receive coaching, which may include body measurements, weight, progress photos, training and nutrition logs, check-in notes, injuries or limitations, availability and your messages with us. Payments are handled by a third-party payment processor, and we do not store full card details on this website.

Campaign information. If you arrive from a link with tracking tags (for example utm_source), we store those tags with your form submission so we know which link brought you here.

Technical information. Our hosting provider may automatically log technical data such as IP address, browser type, pages requested and timestamps, for security and to keep the site running. We do not currently use advertising or analytics cookies or trackers. Our pages load fonts from Google Fonts, which means your IP address is sent to Google’s servers when a page loads.

3. Health-related and sensitive information

Body weight, body measurements, fitness goals, injuries and similar details can be considered health-related information in some countries. We ask only for what we need to give you a useful result or coaching, and we use it only for the purposes in this policy. Please do not send medical records, diagnoses or other sensitive information unless you are a coaching client and we have asked for it. By submitting a form or sharing this information with us, you give your explicit consent to our handling it as described here. You can withdraw that consent at any time by contacting us (see section 12), although this may mean we can no longer provide the related service.

4. How we use your information, and our legal bases

  • To provide what you ask for, such as calculating and sending your scorecard result, sending the Reset guide, reviewing your application and contacting you about it, and delivering coaching (performance of a contract, or steps you ask us to take before a contract).
  • To communicate with you about your request, your coaching, or administrative matters (contract and legitimate interests).
  • To send marketing emails such as coaching tips and offers, only if you opt in (consent). You can unsubscribe at any time using the link in any email or by contacting us.
  • To run and improve the business and keep it secure, including preventing spam and abuse, understanding which links work, and keeping records (legitimate interests).
  • To meet legal obligations, such as tax, accounting and responding to lawful requests (legal obligation).
  • To handle health-related details you give us (explicit consent, which you can withdraw).

Where we rely on legitimate interests, we balance them against your rights and interests. You may object at any time.

5. Automated scoring

The Scorecard calculates your score, tier and estimates automatically using the answers you enter. These are general educational estimates. They are not medical advice, a diagnosis or a prescription, and they do not produce any legal or similarly significant effect on you. We may personally review a result you send us in order to follow up with you.

6. Who we share information with

We share personal information only as needed, with:

  • Service providers that help us operate, including website hosting and form-processing (Netlify), email and communication providers, scheduling or video-call tools, coaching or tracking tools, and payment processors. They may use your information only to provide services to us.
  • Professional advisers and authorities (such as accountants, lawyers, courts or regulators) when needed to protect our legal rights or comply with the law.
  • A successor business if BA40 is sold or reorganized, with notice to you where required.

We do not sell your personal information. We do not share it with third parties for cross-context behavioral advertising. We do not use it for advertising profiles.

7. International transfers

We operate from Canada, and our providers may process information in Canada, the United States and other countries. If you are in the European Economic Area, the United Kingdom, Switzerland or another region with transfer rules, we use appropriate safeguards where required, such as standard contractual clauses or equivalent arrangements with our providers. Laws in those countries may differ from those where you live.

8. How long we keep it

  • Reset and Scorecard submissions: until you ask us to delete them or unsubscribe, and in any case no longer than 24 months from your last interaction with us.
  • Coaching applications that do not become coaching: up to 24 months.
  • Coaching clients: for the length of the coaching, then for up to 6 years afterward for legal, tax, accounting and dispute purposes. Progress photos and detailed body data are deleted sooner if you ask, unless the law requires us to keep them.
  • Marketing consent records: for as long as needed to prove your consent or opt-out.

When information is no longer needed we delete it or anonymize it.

9. Security

We use reasonable technical and organizational measures to protect your information, including encrypted connections (HTTPS) and restricted access. No website or transmission method is completely secure, so we cannot guarantee absolute security. Please contact us right away if you believe your information has been compromised.

10. Cookies and tracking

This site does not currently set advertising or analytics cookies. If we add analytics, advertising or similar tools in the future, we will update this policy and ask for your consent first wherever the law requires it.

11. Children

BA40 is for adults aged 18 and over. We do not knowingly collect information from anyone under 18. If you believe a child has given us information, contact us and we will delete it.

12. Your rights

Depending on where you live, you may have the right to: know what personal information we hold about you and get a copy; correct it; delete it; restrict or object to our use of it; receive it in a portable format; withdraw your consent at any time; and not be subject to decisions based solely on automated processing that significantly affect you. We will not treat you unfairly for exercising your rights.

How to use your rights. Email coach@ba40fit.com from the address you gave us, and tell us what you would like. We may need to verify your identity first. We aim to respond within 30 days, or within the time required by the law that applies to you. You may use an authorized agent where the law allows, and we may ask for proof of authority.

European Economic Area, United Kingdom and Switzerland. You have the rights above under the GDPR and equivalent laws, and you may complain to your local data protection authority.

Canada. You have rights under the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial laws, including Quebec’s Law 25. You may complain to the Office of the Privacy Commissioner of Canada or your provincial regulator, for example the Commission d’accès à l’information du Québec.

United States. Residents of California and other states with privacy laws may have the rights to know, access, correct and delete personal information, and to opt out of its sale or sharing. We do not sell or share personal information as those laws define them. We do not knowingly process sensitive personal information for purposes other than providing the services you request.

Australia, New Zealand, Brazil, and elsewhere. We respect the privacy rights provided by your local law, including the Australian Privacy Principles, the New Zealand Privacy Act and Brazil’s LGPD. You may contact your local privacy regulator if you have a concern we have not resolved.

Marketing emails. You can opt out at any time by using the unsubscribe link or emailing us. We will still send you messages that are necessary for your request or coaching.

13. Third-party links

Our site may link to other websites. We do not control them and are not responsible for their privacy practices. Please read their policies.

14. Health disclaimer

BA40 provides general fitness coaching and educational information. It is not medical care, diagnosis or treatment, and it does not replace advice from a licensed health professional. Talk to your doctor before starting any training or nutrition program, especially if you have a medical condition, injury or concern.

15. Changes to this policy

We may update this policy as our services or the law change. We will post the new version here with a new “last updated” date. If a change is material, we will notify you in a way that fits the situation, and ask for your consent again where the law requires it.

16. Contact and complaints

Questions, requests or complaints: coach@ba40fit.com. If you are not satisfied with our response, you have the right to contact the privacy or data protection authority where you live or work.
